Philadelphia-area doctor agrees to resolve civil allegations of improper prescribing of controlled substances

Dr. Mattingly Will Pay $72,000 and Agrees to Permanent Ban on Future Prescribing of Oxycodone and Almost All Other Controlled Substances.

PHILADELPHIA – United States Attorney Jacqueline C. Romero announced that Dr. David L. Mattingly, a doctor of osteopathic medicine in the Philadelphia area, has agreed to resolve allegations that he improperly prescribed opioid controlled substances to individuals. Dr. Mattingly will pay $72,000 to the United States and agree to strict limitations preventing him from prescribing almost all controlled substances, including drugs like oxycodone.

Under the Controlled Substances Act, physicians like Mattingly are registered with the DEA and are generally permitted to prescribe controlled substances only based on a valid prescription. A prescription is valid only when issued for a legitimate medical purpose and in the usual course of professional practice. That legal obligation applies to controlled substances broadly and includes drugs like the opioid oxycodone. The settlement between the United States and Mattingly resolves allegations that, from February 5, 2015, through September 1, 2018, Mattingly illegally prescribed opioid controlled substances like oxycodone without satisfying these important legal obligations as to a certain number of patients whose records were subpoenaed by the Drug Enforcement Administration (DEA). The settlement agreement covers liability under the Controlled Substances Act, which imposes substantial civil penalties for illegal controlled substance prescriptions.

The settlement agreement permanently prevents Mattingly from prescribing almost all controlled substances, including oxycodone. Mattingly also entered into an administrative agreement with the DEA that includes additional compliance measures, such as continuing education courses.

“Doctors like Mattingly have a responsibility to their patients and the community when they prescribe controlled substances, particularly opioids like oxycodone,” said U.S. Attorney Romero. “It is critical that physicians uphold that responsibility and focus on the safety and well-being of their patients. When they do not and they violate the law by illegally prescribing controlled substances like oxycodone, my office will not hesitate to hold them accountable.”

“Doctors are required to satisfy a two-prong standard when prescribing controlled substances; the first of which is that the prescription be issued for a legitimate medical purpose and the second being that it is done in the usual course of professional practice,” said Thomas Hodnett, Special Agent in Charge of the Drug Enforcement Administration’s (DEA) Philadelphia Field Division. “As part of his obligations under the Controlled Substances Act, Dr. Mattingly was required to ensure that both of these standards were met when he prescribed powerful painkillers such as oxycodone.”

The case was investigated by the Philadelphia Field Division of the DEA. The civil investigation and settlement were handled by Assistant United States Attorney Anthony D. Scicchitano, Investigator Jeffrey Braun, and Auditor Dawn Wiggins.

The claims resolved by this settlement are allegations only and there has been no determination of liability.

President Joe Biden’s decision to step down as the Democratic Party’s nominee for president opens the door for other contenders to become the Democratic nominee in November. The president has thrown his support behind Vice President Kamala Harris, and other prominent Democrats moved quickly to rally around her candidacy, but it’s unclear just how smooth her path to the party’s nomination is. Here are some of the leading contenders for a spot on the Democratic ticket:

Kamala Harris

Born in Oakland, California, Vice President Kamala Harris calls Thurgood Marshall an inspiration and talks often about growing up with parents deeply involved in the civil rights movement.

Her economist father and cancer specialist mother met as graduate students at the University of California, Berkeley, where Harris recalled they spent ample time «marching and shouting about this thing called justice.”

In choosing Harris as his running mate in 2020, Biden called her a “fearless fighter for the little guy.” She has not wavered as his vice-presidential nominee and has become more visible campaigning for the Biden-Harris ticket in recent weeks.

Harris, who is Black and also of South Asian descent, is the nation’s first female vice president and the first person of color to hold that office. A graduate of Howard University, she also is the first person from a historically Black college or university to hold the office of either president or vice president.

Harris won her seat in the U.S. Senate in 2016 after twice being elected California attorney general. As a Senate candidate, she stressed her fights with big banks during the mortgage crisis, for-profit colleges that were financially exploiting students and environmental wrongdoers.

She’s talked for years about recidivism and criminal justice reform, and pushed for a different approach to non-violent crimes that emphasizes rehabilitation instead of severe, one-size-fits-all punishment. She calls it smart on crime.

As vice president, Harris has been asked by Biden to take on some of the most challenging tasks his administration has faced, including securing the nation’s borders. As the presiding officer of the U.S. Senate, she has cast a record number of tie-breaking votes on legislation promoted by Democrats, who are defending a razor-thin majority in both houses of Congress in this year’s elections.

Harris, 59, is married to Los Angeles lawyer Douglas Emhoff.

J.B. Pritzker

Illinois Gov. J.B. Pritzker, the richest politician holding office in the U.S., is an heir to the Hyatt Hotel fortune, a former private equity investor and philanthropist. His net worth of $3.4 billion puts him at No. 250 on the Forbes 400 list of the richest Americans.

The 59-year-old Pritzker won the nomination for governor in 2018, besting a crowded Democratic field. He beat one-term incumbent Republican Gov. Bruce Rauner and inherited mountains of state debt, unpaid bills and ratings by Wall Street credit houses just above junk status because of Rauner’s two-year feud with legislative Democrats that resulted in the state going without a budget plan.

Working with Democratic supermajorities in the House and Senate, Pritzker has boasted balanced budgets and paid down billions of dollars in debt, prompting multiple credit upgrades. He also has overseen increased education funding, the centralization of early childhood services, and new laws to make health insurance more comprehensive, accessible and affordable.

After receiving generally high marks for his handling of the COVID-19 pandemic, he defeated a Trump-endorsed MAGA Republican with 55% of the vote, becoming the first Illinois governor to be elected to a second term in 16 years. He then promptly delivered a victory speech that sounded like it came from a national candidate, denouncing Trump and asking, “Are you ready to fight?”

Even before his reelection, when there was speculation Biden might not seek a second term, Pritzker was criticized for saying he was happy being governor while traveling to the early primary state of New Hampshire and campaigning for or funding Democratic candidates nationally. And he’s continued to boost his coast-to-coast profile by bankrolling a political organization called “Think Big America” that aims to protect abortion rights and has supported state constitutional amendments to strengthen those protections in Ohio, Arizona and Nevada.

Gretchen Whitmer

Michigan Gov. Gretchen Whitmer has rapidly risen in prominence within the Democratic Party since first winning the 2018 gubernatorial election after serving for a decade and a half in the state Legislature.

Her national profile grew significantly during the final years of Donald Trump’s presidency when she emerged as one of the Democratic Party’s most effective voices opposing the then-president. She delivered the Democratic response to Trump’s 2020 State of the Union address and frequently clashed with him over how the federal government handled the COVID-19 pandemic.

Near the end of 2020, the FBI uncovered a plot to kidnap Whitmer, which led to nine men either being convicted by jury or pleading guilty.

In her 2022 reelection campaign, Whitmer focused on reproductive rights, resulting in a double-digit victory and passage of a voter-approved measure codifying abortion rights in the state. Her party also flipped both chambers of the state Legislature, securing a Democratic trifecta for the first time in nearly four decades.

The massive Democratic victories in a swing state that Trump won in the 2016 presidential election positioned Whitmer as a leading advocate for reproductive freedom and a strong contender for a future presidential nomination.

Whitmer — who was one of the top surrogates for Biden’s reelection campaign — has long deflected questions about whether she has interest in higher office, telling The Associated Press earlier this month that she would not step in as a candidate this year if Biden were to step aside.

But the 52-year-old Democrat has been working to boost her national profile. She met with Biden in 2020 as he considered who to select as a running mate and she is currently on a national press tour for her new memoir. Whitmer has also set up a national political action committee that has raised millions this election cycle.

Gavin Newsom

California Gov. Gavin Newsom is a native of San Francisco who got involved in politics by volunteering for Willie Brown’s 1995 campaign for mayor. Two years later, Mayor Brown appointed Newsom to a vacant seat on the San Francisco Board of Supervisors, where he was later elected and reelected.

Newsom then became mayor himself and received national attention in 2004 when he directed the San Francisco clerk to issue marriage licenses to same-sex couples.

He was elected lieutenant governor in 2010 and unapologetically pushed a progressive agenda when he successfully ran for governor eight years later. Now in his second term, he says he is “standing up for California values — from civil rights, to immigration, environmental protection, access to quality schools at all levels, and justice,” according to his official bio.

Newsom, 56, has maintained a high national profile this year, challenging Republican presidential candidates in public appearances despite not being a candidate himself. He has been one of Biden’s staunchest defenders even as criticism mounted following the president’s faltering debate performance. During an early July stop in New Hampshire on behalf of the president, Newsom said of Biden: “He’s going to be our nominee.”

The governor was a baseball star at Santa Clara University. After graduating, he worked briefly in sales before starting a retail wine shop that grew into the PlumpJack Group, which includes restaurants, resorts and vineyards throughout California.

He is married to Jennifer Siebel Newsom. They have four children.

Josh Shapiro

Pennsylvania Gov. Josh Shapiro, long seen as a rising political star in Pennsylvania, is halfway through his second year as governor after easily winning his last election by trouncing a far-right, Donald Trump-endorsed candidate in the premier presidential battleground.

Shapiro, 51, has been a surrogate for Biden, backing the president in appearances on cable networks, and has years of experience making former President Trump the focus of his attacks, first as state attorney general and now as governor.

If he joins a Democratic ticket, Shapiro would become the first presidential nominee of Jewish heritage or the second vice presidential nominee of that background, after former Democratic Sen. Joe Lieberman of Connecticut in 2000.

Shapiro has won three statewide races — two as attorney general, one as governor — with a tightly scripted, disciplined campaign style, offering voters something of a lower-key alternative to the state’s brash political star, U.S. Sen. John Fetterman.

As governor, Shapiro has begun to shed a buttoned-down public demeanor and become more confident and plain-spoken. In one recent MSNBC appearance, he said Trump should “quit whining” and stop “sh— talking America.”

Shapiro has aggressively confronted what he viewed as antisemitism cropping up from pro-Palestinian demonstrations, and has professed solidarity with Israel in its drive to eliminate Hamas.

He is a staunch proponent of abortion rights in Pennsylvania and routinely touts his victories in court against Trump, including beating back challenges to the 2020 election results.

He also has positioned himself as a moderate on energy issues in the nation’s No. 2 natural gas state and plays up the need for bipartisanship in the politically divided state government.

Roy Cooper

North Carolina Democratic Gov. Roy Cooper has won six statewide general elections over two decades in a state where Republicans routinely prevail in similar federal races and also control the legislature.

Cooper, 67, has received strong job-approval ratings as governor, benefitting from a booming state economy, for which his administration and lawmakers takes credit. He also portrays himself as a fighter for public education and abortion rights. While Cooper finally persuaded GOP legislators last year to expand Medicaid under the Affordable Care Act, other efforts have been thwarted by a General Assembly with veto-proof majorities that has eroded his formal powers.

A native of small-town Nash County, about 50 miles (80 kilometers) east of Raleigh, Cooper was his high school quarterback and head of the Young Democrats at the University of North Carolina, where he obtained both his undergraduate and law degrees. “Coop,” as he was known to friends, came home and worked at his father’s law firm.

Cooper upset the Democratic incumbent in a 1986 state House primary race and was elected to the General Assembly. He served 14 years there and later became the Senate majority leader.

Cooper was elected attorney general in 2000, a position he held for 16 years. In that post, he’s likely best known nationally for declaring three former Duke University lacrosse players innocent after they were wrongly accused of sexual assault by an escort service dancer.

Cooper unseated another incumbent in 2016, this time Republican Gov. Pat McCrory by roughly 10,000 votes. A top campaign issue was the “bathroom bill” that McCrory signed requiring transgender people to use public restrooms that corresponded with the sex on their birth certificates. As governor, Cooper quickly reached an agreement with legislators to partially repeal the law.

His time as governor also was marked by restricting business and school activity during the COVID-19 pandemic. He won reelection in 2020 by 4.5 percentage points, even as Donald Trump won the state’s electoral votes.

Cooper and his wife, Kristin, have three grown daughters.

Andy Beshear

Kentucky Gov. Andy Beshear secured his reputation as a rising Democratic star by beating Trump-endorsed Republicans in his bright red state.

He displayed a disciplined, tenacious style in winning reelection last year, defeating then-Attorney General Daniel Cameron. The governor has urged Democrats to follow his winning formula by focusing on the everyday concerns of Americans, from good-paying jobs to quality education and health care.

Beshear supports abortion rights, but in Kentucky has tailored his message to push back against what he calls an extreme ban that lacks exceptions for rape and incest victims.

The governor won widespread praise for his empathy and attention to detail in guiding the Bluegrass State through the COVID-19 pandemic and leading the response to tornadoes and flooding that caused massive damage. He honed his speaking skills by holding regular news conferences that often last an hour or so.

Beshear has presided over record-setting economic growth in Kentucky, and he typically begins his briefings by touting the state’s latest economic wins. He frequently mentions his Christian faith and how it guides his policymaking.

An attorney by trade, Beshear won election as state attorney general in 2015. He then unseated Trump-backed Republican incumbent Matt Bevin to first win the governorship in 2019.

Beshear entered politics with a strong pedigree as the son of former two-term Gov. Steve Beshear, but the son has faced tougher political obstacles. Andy Beshear, unlike his dad, has dealt with an entirely GOP-controlled Legislature and Republican lawmakers have stymied some of his priorities. One of them is state-funded preschool for every Kentucky 4-year-old.

Mark Kelly

U.S. Sen. Mark Kelly of Arizona leveraged his career as an astronaut to build a brand as a moderate in a state that long supported Republicans.

In his two campaigns — the first in 2020 to finish the late Republican Sen. John McCain’s last term, and the second two years later for a full term — Kelly has earned more votes than any other Democrat on the ballot. He outpolled Biden, who narrowly won Arizona, by 2 percentage points in 2020.

Kelly’s first turn in the national political spotlight came through tragedy. His wife, then-U.S. Rep. Gabrielle Giffords, was shot in the head while meeting with constituents outside a grocery store in Tucson, a shooting that left six people dead and spawned an early reckoning with political violence and partisan rancor.

Giffords’ improbable survival made her a national inspiration but snuffed out a promising political career of her own. She and Kelly went on to found a gun-control advocacy group, and Giffords has been a powerful surrogate as Kelly has taken her place in politics.

In the Senate, Kelly has focused on national security and the military as well as the drought plaguing the U.S. West. He was instrumental in crafting the CHIPS and Science Act, a bill signed by Biden to boost U.S. semiconductor manufacturing.

Kelly was a Navy test pilot and flew 39 combat missions during the Gulf War before joining NASA, where he flew three missions on the space shuttle.

Originally from New Jersey, he settled with Giffords in Tucson after retiring from NASA and the Navy.

Unlike Sen. Kyrsten Sinema, who was elected as a Democrat two years before Kelly but later left the party to become an independent, Kelly has managed to retain the support of the party’s grassroots base without alienating independent voters. —By Jonathan J. Cooper

Por qué ACLU de Pensilvania está demandando al estado por el financiamiento de los defensores públicos

Si alguna vez ha visto un programa de televisión o una película que incluye a la policía como parte de la trama, es probable que haya escuchado la frase «Tiene derecho a un abogado. Si no puede pagar un abogado, se le proporcionará uno sin costo alguno”.

Ese derecho no es ficción, es un hecho.

Según la Constitución de los Estados Unidos y la del estado de Pensilvania, cualquier persona acusada de un delito tiene derecho a asistencia jurídica. Este derecho ha sido reafirmado durante 60 años por ambas cortes supremas, quienes lo han descrito como una de las “barreras esenciales contra la privación arbitraria e injusta de los derechos humanos”.

A pesar de que este derecho está consagrado en la doctrina jurídica y la cultura pop, la intención de este no es sólo tener una presencia física con un título en derecho sentado a tu lado en el tribunal. El derecho a un abogado es el derecho a un abogado competente. Este derecho significa que un defensor público o un abogado designado por el tribunal debe tener el tiempo, los recursos, capacitación y capacidad para preparar adecuadamente y defender enérgicamente a sus clientes.

Desafortunadamente, Pensilvania no proporciona financiamiento estatal para los defensores públicos. En cambio, ELA deja casi todo el financiamiento  y el control de las oficinas de defensores públicos a la discreción de cada condado.Dejando a los condados con menos oportunidades de recaudar ingresos. Y en la política local, el apoyo a servicios para adultos mayores, carreteras, salud pública y aplicación de la ley siempre prevalecerá sobre una oficina que, por diseño, atiende sólo a personas acusadas de delitos que no pueden pagar un abogado privado.

La falta de financiamiento estatal para los defensores públicos significa que las personas arrestadas y encarceladas a menudo no se reúnen con un abogado durante días o incluso semanas.

Esto es claramente inconstitucional.

Por eso, después de más de dos años de investigación, análisis de datos, observación judicial e innumerables entrevistas con participantes en el proceso penal, especialmente los defensores públicos y sus clientes, ACLU de Pensilvania demandó al estado. Nuestra demanda solicita al tribunal multar a la delegación de Pensilvania de brindar casi todo el financiamiento y control de los defensores públicos a los condados lo cual viola las Constituciones de Pensilvania y de Estados Unidos. El commonwealth tiene la obligación última

garantizar que los defensores públicos de Pensilvania puedan brindar la asesoría legal requerida constitucionalmente. 

Para ser claros, esto no es un ataque a los defensores públicos. La gran mayoría son profesionales trabajadores, dedicados y con muy pocos recursos. El problema no son ellos; el problema es el sistema bajo el que trabajan. Incluso el abogado más talentoso no podría brindar una representación efectiva con una carga de casos que solo permite unos minutos para ayudar a cada cliente.

ACLU de Pensilvania no es la única que hace sonar la alarma sobre la crisis de financiamiento de defensa pública en el Commonwealth.

Un estudio reciente realizado por el Centro Quattrone de la Facultad de Derecho Penn Carey de la Universidad de Pensilvania encontró que al menos 64 de los 67 condados de Pensilvania no tenían suficientes abogados en sus oficinas de defensores públicos para cumplir con los estándares establecidos.

El estudio de Quattrone también identificó 47 condados de Pensilvania que necesitarían más del doble de personal de abogados para cumplir con los estándares nacionales.

Una buena noticia es que muchos de los líderes electos de Pensilvania han reconocido la crisis de financiamiento y han comenzado a dar algunos pequeños pasos para abordarla. El gobernador Josh Shapiro obtuvo $7,5 millones en su propuesta de presupuesto anual 2023-24 para financiar a defensores públicos y ha propuesto $10 millones adicionales del presupuesto del próximo año. Es un buen comienzo, pero no es suficiente.

Tener oficinas de defensores públicos totalmente financiadas es la única manera de garantizar que todos los habitantes de Pensilvania tengan una oportunidad justa de navegar por el sistema legal penal. La Constitución exige que el derecho a una representación efectiva no sea sólo para los ricos.

Cientos de miles de residentes de Pensilvania se ven afectados directamente cada año por la crisis de recursos para la defensa pública. El Partido Demócrata podría apostar por la vicepresidenta Kamala Harris como candidata frente al expresidente Donald Trump en las elecciones de noviembre, en un arriesgado intento por superar el racismo y el sexismo que aún persisten en algunos sectores de Estados Unidos y que Trump ha sabido explotar en su beneficio.

Harris debe primero consolidar su apoyo dentro del partido, donde la opinión de exdirigentes y líderes del Congreso será crucial. Sin embargo, el caucus afroamericano del Congreso, que agrupa a los miembros de esa minoría, ya se ha lanzado a respaldar a la vicepresidenta, de origen jamaicano e indio.

Algunos de sus miembros, como el influyente James Clyburn de Carolina del Sur, han dejado claro que verían como una traición cualquier intento del partido por marginar a Harris, dado que tanto las mujeres como los afroamericanos constituyen pilares fundamentales de la base demócrata.

Al anunciar este domingo el fin de su campaña, el presidente estadounidense, Joe Biden, declaró que ofrecía su «apoyo total» a Harris para ser la nominada del partido para las elecciones de noviembre. «Demócratas, es hora de unirnos y vencer a Trump. Hagámoslo», pedía.

Sin embargo, destacadas figuras del partido, como el expresidente Barack Obama, la expresidenta de la Cámara Baja Nancy Pelosi o el líder de la mayoría demócrata del Senado, Chuck Schumer, aún no han manifestado su respaldo a Harris ni a ningún otro candidato.

Un techo de cristal por romper

La realidad es que Harris se enfrenta a un desafío histórico. En toda la historia de Estados Unidos, los votantes solo han elegido a un presidente afroamericano: Barack Obama (2009-2017).

El propio Trump, entonces un magnate inmobiliario y estrella de la televisión, llegó a difundir teorías conspiratorias cuestionando la legitimidad de Obama como presidente, al poner en duda su lugar de nacimiento, ya que la Constitución exige que el mandatario sea ciudadano nacido en EE. UU.

Estados Unidos tampoco ha elegido antes a una mujer como presidenta. En las elecciones de 2016, la demócrata Hillary Clinton fue la primera nominada a la Presidencia por uno de los dos principales partidos políticos del país, pero perdió frente a Trump, que la llamaba «Corrupta Hillary».

Como ya ocurrió en las elecciones de 2016 con Clinton y en los dos anteriores ciclos electorales con Obama en 2012 y 2008, la raza y el género serán parte central de la campaña si Harris acaba siendo la candidata.

Esto se verá acentuado porque enfrente de Harris está Trump, quien «tiene un discurso populista marcado por el racismo, la xenofobia y el odio hacia el otro, es decir, todo aquel que no es un hombre blanco», dijo a EFE la analista Yamila Pino.

Trump ya ha dejado entrever en su mitin del sábado en Grand Rapids (Michigan) cómo atacará a Harris, a quien definió como «Risas Kamala». «Se puede decir mucho por su risa. Está loca; le falta un tornillo», añadió en tono despectivo.

Un contraste innegable

En opinión de Pino, «no se puede tapar el sol con un dedo» y es innegable el contraste entre Trump y Harris, quien podría hacer historia como la primera mujer con raíces afroamericanas nominada por uno de los grandes partidos y también, si lo logra, como primera mujer afroamericana en llegar a la presidencia.

Antes que ella la única mujer negra en hacerlo fue Shirley Chisholm, quien en 1972 aspiró a la nominación de uno de los dos grandes partidos para la Presidencia de EE. UU. Sin embargo, no logró ser la candidata demócrata para esos comicios en los que el elegido fue George McGovern, quien perdió frente a Richard Nixon.

Cincuenta años después, la barrera racial y de género sigue siendo un obstáculo formidable en la política estadounidense, como lo demuestra el hecho de que nunca se haya elegido a una gobernadora afroamericana. La campaña de Stacey Abrams a la gobernación de Georgia en 2018 generó un gran entusiasmo, pero no logró superar esa barrera histórica.

En ese escenario, el cambio solo puede ser gradual. Por tanto, si Harris es elegida como candidata a la Casa Blanca, lo más posible es que su compañero de fórmula fuera un hombre blanco.

En la lista de posibles figura Josh Shapiro, que tiene la ventaja de ser gobernador del estado clave de Pensilvania, o los gobernadores de Carolina del Norte, Roy Cooper, y Kentucky, Andy Beshear, dos estados que votan republicano en las elecciones presidenciales, por lo que su perfil podría atraer a votantes moderados.

Grupos latinos agradecen a Biden su política social y migratoria tras retiro electoral

Influyentes grupos latinos en EE. UU. han mostrado su agradecimiento al presidente Joe Biden por su «sacrificio» al retirarse de la campaña para la reelección, pero principalmente por su apoyo a la comunidad hispana con políticas sociales y migratorias durante tres años y medio de mandato.

Estas organizaciones, sin embargo, no se han pronunciado por ahora en apoyo a una eventual nominación a la Casa Blanca de la vicepresidenta del país Kamala Harris, a quien Biden dio su apoyo el domingo después de anunciar su retiro de campaña.

La organización Voto Latino resaltó que durante el gobierno del actual gobierno Biden-Harris se ha restablecido el programa migratorio DACA para los «soñadores», ha ayudado a agilizar la legalización de cónyuges indocumentados de ciudadanos y ha brindado protección continua a salvadoreños, hondureños, nicaragüenses y venezolanos a través del Estatus de Protección Temporal (TPS).

«Respetamos la difícil decisión de principios del presidente Biden de no buscar la reelección y anteponer el mejor interés del país», dijo Janet Murguía, presidenta y directora ejecutiva de UnidosUS.

La Liga de Ciudadanos Latinoamericanos Unidos (LULAC, en inglés), el grupo hispano más antiguo del país se expresó de forma similar.

La Administración Biden «ha buscado mejorar las oportunidades económicas, el acceso a la educación, la cobertura de atención médica y la protección de los trabajadores para la comunidad latina y al mismo tiempo abordar cuestiones críticas de inmigración», subrayó este grupo creado en 1929.

LULAC además recordó el papel electoral «clave» de los latinos, que representan casi el 15 % del electorado y han crecido al segundo ritmo más rápido de cualquier grupo racial o étnico importante en el electorado estadounidense desde las elecciones presidenciales de 2020.

Un «récord» de 17,5 millones de hispanos acudirá a las urnas en noviembre próximo, según las proyecciones de la Asociación Nacional de Funcionarios Latinos Electos y Designados (NALEO).

En un escueto mensaje, Arturo Vargas, director de NALEO, agradeció al presidente Biden por su «servicio» durante su mandato.

En primer lugar, nos encontramos en una encrucijada. Cuando Joe Biden asumió la presidencia después de derrotar a Donald Trump, sentimos una sensación de alivio. Su gobierno no sólo promulgaría políticas sólidas en materia de inmigración, sino que también esperábamos que cumpliera su palabra con respecto a la seguridad social, la deuda estudiantil, el alto precio de las recetas y una docena de otras promesas que hizo durante la campaña.

Por el otro lado, Donald Trump representa un peligro claro y presente para nuestra democracia, el Estado de derecho y nuestro lugar en el escenario mundial. Sus políticas alienaron a los amigos y alentaron a nuestros enemigos.

Joe Biden parecía una apuesta segura para la reelección, teniendo en cuenta el estado de la economía y la restauración de nuestra credibilidad en el exterior. Su débil desempeño en el primer debate con Donald Trump reveló que el estado físico y mental del presidente se había deteriorado.
Fuimos testigos de un cambio drástico entre el Estado de la Unión y el debate. Casi de inmediato hubo llamados para que renunciara y permitiera que Kamala Harris se postulara para la presidencia. Resistió hasta que el coro se volvió demasiado ruidoso para ignorarlo y comenzó a considerar el final de su carrera.

Comentaristas bien informados afirmaron que necesitaba defender su legado, abandonándose por su propia voluntad en lugar de votar en su contra por parte de su propio partido. Joe Biden ha tomado el camino correcto y ha presentado su dimisión para dejar la vía abierta al Partido Demócrata para elegir un candidato presidencial tras su desastrosa actuación en el debate.

El país estará eternamente agradecido por su decisión, que demuestra que eligió el bien de la nación por encima de todas las cosas.

El principal problema del partido es buscar al vicepresidente adecuado que se una a Kamala Harris. Los nombres de gobernadores y legisladores estuvieron en boca de los críticos de los medios. Inmediatamente pensamos en un nombre que no mucha gente consideraría. El almirante retirado James Stavridis podría ser un tremendo activo para la candidatura del Partido Demócrata.

Su nombre ya había aparecido en la escena nacional cuando Hillary Clinton empezó a buscar posibles compañeros de fórmula. El currículum del almirante es impresionante, al igual que su energía. Se le ha visto en Morning Joe de MSNBC y en otros programas en su función de consultor en asuntos internacionales.

Sus comentarios son siempre elocuentes, informativos e informados, y se entregan de manera clara, y cuando aborda las cuestiones de Israel y Gaza, o la constante amenaza de Irán de desestabilizar el Medio Oriente. Inspira confianza y sus intervenciones ilustran su ascenso a los niveles más altos de su tiempo en la Marina de los Estados Unidos y como comandante militar en Europa.

Su presencia en la lista presidencial proporcionaría a Kamala Harris una abundante experiencia en política exterior. Quizás también, convencer a los militares, a sus familias y al resto de nosotros de que el equipo Harris-Stavridis guiaría las políticas de este país en la dirección correcta, restaurando la fe en nuestras instituciones y la confianza en todo el mundo.

Joe Biden ha decidido no buscar la reelección y expresado su apoyo a Kamala Harris para la nominación demócrata en las elecciones de noviembre. La contienda en las urnas será con el nominado republicano y expresidente de EE. UU. Donald Trump.

Tras la decisión del presidente Joe Biden de retirar su candidatura para su reelección en los comicios de noviembre, el escenario político en Estados Unidos ha dado un giro. En un mensaje publicado en las redes sociales, Biden ofreció su «apoyo y «respaldo» a la vicepresidenta Kamala Harris, para que sea la nominada para enfrentar al republicano Donald Trump en las urnas.

Harris podría ser la sucesora natural, pero está por ver si finalmente será así. La razón es que a partir de ahora se abre la puerta para que otros demócratas puedan también presentar sus candidaturas y aspirar así a su nominación en la próxima Convención Nacional Demócrata, que tendrá lugar del 19 al 22 de agosto en la ciudad de Chicago.

Estos son los nombres que más suenan entre los círculos demócratas:

Kamala Harris

La actual vicepresidenta de Estados Unidos, Kamala Harris, es el nombre que suena con más fuerza para suceder a Joe Biden como candidato en los comicios de noviembre. En los últimos días, Harris se ha dejado ver con frecuencia en varios eventos de campaña.

Es la opción oficial más fiable porque Kamala Harris es la actual vicepresidenta y porque el propio Biden la impulsaría como su alternativa. Pero sobre la mesa está la baza de la popularidad ya que hay muchas dudas al respecto.

Una nueva encuesta del Centro de Investigación de Asuntos Públicos AP-NORC publicada el viernes 19 de julio señaló que aproximadamente 6 de cada 10 demócratas creen que Kamala Harris haría un buen trabajo al frente de la Casa Blanca. Aproximadamente 2 de cada 10 demócratas no creen que lo haría, y otros 2 de cada 10 dicen que no saben lo suficiente para opinar.

Desde el debate presidencial del 27 de junio, muchos demócratas han mirado en privado e incluso abiertamente a Harris para que intervenga y suceda a Biden como el candidato presidencial del partido, creyendo que tiene una mejor oportunidad contra el nominado republicano Donald Trump.

En cambio, otro sondeo de hace un mes de POLITICO/Morning Consult indica que solo un tercio de los votantes cree que Kamala Harris tendría posibilidades de ganar una elección si se convirtiera en la candidata oficial del Partido Demócrata.

El estudio coincide con el anterior ya que, dentro de su propio partido, tres de cada cinco demócratas piensan que ella podría ganar. Entre los votantes independientes, solo una cuarta parte cree que Harris saldría victoriosa.

Este escepticismo también se refleja en cómo los votantes perciben su capacidad para liderar su partido en el futuro. El 42 % de los votantes la considera una líder fuerte, lo que incluye a tres cuartas partes de los demócratas pero solo a un tercio de los independientes.

La encuesta también muestra que Harris tiene calificaciones negativas similares a las de Biden. Ambos tienen más opiniones desfavorables que favorables: Biden cuenta con un 43 por ciento de opiniones favorables y un 54 % desfavorables, mientras que Harris tiene un 42 % de opiniones favorables y un 52 % desfavorables.

En más de dos siglos de democracia, los votantes estadounidenses han elegido solo a un presidente afroamericano y nunca a una mujer, lo cual hace que incluso algunos votantes afroamericanos se pregunten si Harris podrá romper la barrera más difícil en la política de EEUU.

Harris enfrentaría otros grandes retos: si fuera promovida como la candidata principal, solo tendría tres meses para hacer campaña y unificar al partido y a los donantes a su alrededor. Sin embargo, muchos demócratas están entusiasmados con sus posibilidades.

Harris, de 59 años, es dos décadas más joven que Trump y una figura prominente en el partido en cuanto a derechos de aborto, un tema que resuena con los votantes más jóvenes y la base progresista de los demócratas. Sus partidarios argumentan que ella motivaría a esos votantes, consolidaría el apoyo afroamericano y aportaría habilidades de debate contundentes para argumentar en contra del expresidente.

Apoyo a Harris

Muchos demócratas apoyaron el domingo a la vicepresidenta Kamala Harris para que sea la nominada del partido en las elecciones frente a Donald Trump.

No obstante, algunos relevantes miembros del partido, incluida la expresidenta de la Cámara de Representantes Nancy Pelosi, se mantuvieron en silencio. A poco más de 100 días de las elecciones, Harris necesita consolidar apoyos dentro del partido.

Después del anuncio y respaldo de Biden a la candidatura de Harris, rápidamente le siguieron el poderoso Caucus Negro del Congreso, varios donantes clave, legisladores como la senadora Patty Murray y fondos de campaña como Priorities USA y Unite the Country.

También el expresidente demócrata Bill Clinton y su esposa, la exsecretaria de Estado Hillary Clinton, respaldaron a Kamala Harris para que asuma la candidatura de su partido a las elecciones presidenciales de noviembre.

Dmitri Mehlhorn, asesor de Reid Hoffman, fundador de LinkedIn y uno de los principales donantes demócratas, calificó a Harris como «el sueño americano personificado», destacando que era hija de inmigrantes.

Otros, entre ellos Pelosi, agradecieron a Biden su patriotismo, pero no apoyaron todavía a Harris o a otro candidato.

Gavin Newsom

El gobernador de California, Garvin Newsom, ha ido estableciendo un perfil a nivel nacional.

Newsom, quien asumió como gobernador en 2019, ha tenido una extensa carrera política en California, lo cual podría serle útil si decide postularse para presidente; pero no podría ser compañero de fórmula de Harris, porque ambos representan a California.

La carrera política de Newsom comenzó en 1996 cuando fue nombrado en la Comisión de Estacionamiento y Tráfico. Luego, en 1997, se unió a la Junta de Supervisores de San Francisco, posición que mantuvo hasta que decidió postularse para alcalde.

En 2003, fue elegido alcalde de San Francisco a los treinta y seis años, convirtiéndose en el alcalde más joven de la ciudad en más de un siglo. Fue reelegido en 2007.

En 2010, ganó las elecciones para vicegobernador y fue reelegido en 2014. Más tarde, se presentó para la gubernatura de California y ganó las elecciones de 2018.

En septiembre de 2021, Gavin Newsom enfrentó una elección revocatoria, un proceso constitucional que permite a los residentes de un estado destituir a un gobernador en funciones si así lo desean. Newsom superó esta elección y permaneció en el cargo. En noviembre de 2022, fue reelegido como gobernador, aunque con menos apoyo que en la elección revocatoria del año anterior.

Newsom es conocido por sus políticas contra el cambio climático en California. Ha firmado un paquete de 15.000 millones de dólares para financiar programas que aborden la sequía y el cambio climático tras una temporada devastadora de incendios forestales. También aprobó 24 leyes enfocadas en esfuerzos climáticos y energéticos, sequías y preparación para incendios forestales, lo que representa el mayor paquete climático en la historia de California.

El año pasado, viajó a China para fortalecer el papel de su estado como líder mundial en la lucha contra el cambio climático.

En el pasado, Newsom ha declarado que no competiría con Kamala Harris por una nominación.

Gretchen Whitmer

La gobernadora de Michigan, Gretchen Whitmer, es una figura que ha despuntado entre el sector más progresista del partido demócrata.

Algunos sectores del partido la consideran “una estrella en ascenso” porque ha logrado dos victorias consecutivas en su estado y su protección a los derechos de la comunidad LGBTQIA+ pueden impulsarla.

Ha aprobado más de 1.250 leyes bipartidistas y ha gestionado cinco presupuestos durante su mandato. Desde su oficina, destacan la “reducción de impuestos para jubilados y familias trabajadoras” y proyectos de inversión en educación.

Pete Buttigieg

Hay otros nombres que también han estado sonando en las últimas horas en la prensa estadounidense.

Uno de ellos es Pete Buttigieg, secretario de Transporte del gobierno de EE. UU. Durante su mandato, el alto funcionario ha gestionado la respuesta de la Casa Blanca a importantes emergencias públicas, incluyendo el descarrilamiento de un tren en East Palestine, Ohio, el colapso de un puente en Baltimore y la crisis aérea de Southwest Airlines, en 2022.

Es elogiado entre las filas demócratas porque es considerado uno de los mejores comunicadores de la administración. Buttigieg, que fue alcalde de South Bend, en Indiana, hizo campaña por la nominación presidencial demócrata en 2020, perdiendo ante Biden en las primarias.

Josh Shapiro

Josh Shapiro es otro de los posibles aspirantes a la nominación demócrata en las quinielas. El actual gobernador de Pensilvania ganó las elecciones en 2022 con el 56 % de los votos en un estado clave que Trump ganó por poco margen en 2016. Biden hizo lo propio en 2020, igualmente con un resultado muy ajustado.

Shapiro, que ejerció como fiscal general del estado, ha encauzado sus políticas hacia el bipartidismo durante su mandato. El funcionario demócrata ha mantenido un alto índice de popularidad y aprobación desde que fuera elegido gobernador y ganado reconocimiento nacional después de reconstruir rápidamente un puente colapsado en Filadelfia a lo largo de una carretera estatal crítica.

J.B. Pritzker

El gobernador de Illinois, J.B. Pritzker, se ha destacado por supervisar medidas para proteger los derechos al aborto, además de las políticas de seguridad y control de armas. En los últimos tiempos, también recibió atención nacional por sus duras críticas a Trump y su defensa a Biden.

Pritzker, que gastó 350 millones de dólares en sus dos campañas para gobernador, es heredero de las cadenas de hoteles Hyatt y se estima que su fortuna es de 3.500 millones de dólares.

Andy Beshear

El gobernador de Kentucky, Andy Beshear, también ocupa algunas de las listas de posibles candidatos que pudieran aspirar a la nominación en la Convención Nacional Demócrata. Está cumpliendo su segundo mandato como gobernador en un estado que se ha caracterizado históricamente por ser profundamente conservador.

Ganó su reelección en 2023 por cinco puntos y se ha destacado ante sus compañeros de filas por su éxito en las urnas.

Wes Moore

El gobernador de Maryland, Wes Moore, acaparó la atención de todo el país tras el colapso del puente Francis Scott Key en Baltimore. Las tareas de rescate y el operativo de emergencia que duró varios días, puso el foco nacional en la gestión del funcionario, que podría postularse para ser el candidato demócrata en las próximas elecciones de noviembre.

En el Partido Demócrata defienden «un proceso abierto»

El senador Peter Welch, el primer senador demócrata que pidió a Biden que renunciara a su candidatura a la reelección, pidió un proceso abierto para designar a Harris.

Los demócratas deberían tener «un proceso abierto para que quienquiera que sea nuestro nominado, incluida Kamala, tenga la fuerza de contar con un proceso que muestre la posición consensuada del partido», dijo. «El debate en el Partido Demócrata es quién puede continuar el legado del presidente Biden y derrotar a Trump».

Powered by financial support from Independence Blue Cross, Independence Blue Cross Foundation, Keystone First and Comcast, the bus will make seven Mega Event stops throughout the City of Philadelphia, bringing families critical information and resources.

PHILADELPHIA, PA  The School District of Philadelphia announced plans for the fourth annual Back-to-School Celebration and Bus Tour, which will make seven mega-event stops across the city. This year, Independence Blue Cross, Independence Blue Cross Foundation, Keystone First and Comcast will support the tour, which features two specially-wrapped school buses that will travel across Philadelphia to give students and families access to resources and information. The tour will kick off at 10 a.m. on Monday, July 29 at School of the Future. 

The bus will make stops from 10 a.m. to 2 p.m. on:

  • receive free state-mandated immunizations and the required school and sports physicals thanks to partnerships with Delaware Valley Community Health, Dr. Ala Stanford Center for Health Equity, the Family Practice & Counseling Network and the Philadelphia Department of Public Health.

Each event will also feature food trucks, ice cream and interactive, educational activities for children. The events are co-sponsored by Comcast, Radio One, the Fashion District, FDR Park, and Roosevelt Mall.
